Terms of Service

These Terms of Service ("Terms") govern your use of the Lastlya mobile application ("App") and website ("Site"), provided by Samael Sp. z o.o. ("we", "us", "our"), a company registered in Poland. By using Lastlya, you agree to these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using Lastlya, you confirm that you:
- Are at least 13 years old (or have parental/guardian consent)
- Have the legal capacity to enter into a binding agreement
- Agree to comply with these Terms and our Privacy Policy
If you do not agree, you must not use the service.
2. Description of Service
Lastlya is a personal message vault that allows you to:
- Write text messages, record audio, and capture video messages
- Assign messages to specific contacts (recipients)
- Schedule message delivery based on dates, life events, or inactivity triggers
- Create time capsules with grouped content
- Designate vault trustees to access your content under specified conditions
Lastlya is a tool for personal expression and legacy planning. It is not a legal instrument, last will, or testament. Messages delivered through Lastlya have no legal binding effect.
3. Accounts
3.1 Registration
You must provide a valid email address and create a password to register. You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately if you suspect unauthorized access to your account.
3.2 Account Security
You are solely responsible for all activity that occurs under your account. We are not liable for any loss arising from unauthorized use of your account if such use resulted from your failure to protect your credentials.
3.3 Account Deletion
You may delete your account at any time through the App's Settings. Upon deletion:
- Your personal data will be permanently deleted within 30 days
- Encrypted message content will be deleted immediately
- Messages already delivered to recipients will remain accessible to those recipients
- Active subscriptions should be cancelled through Google Play before deletion
4. Content and Conduct
4.1 Your Content
You retain full ownership of all content you create in Lastlya (messages, recordings, videos). We do not claim any intellectual property rights over your content.
By using the service, you grant us a limited, non-exclusive license to store, encrypt, and transmit your content solely for the purpose of providing the service (storing and delivering your messages).
4.2 Prohibited Content
You agree not to use Lastlya to:
- Send content that is illegal, threatening, harassing, or defamatory
- Distribute malware, spam, or phishing content
- Impersonate another person or entity
- Violate the intellectual property rights of others
- Send content to recipients without their reasonable expectation of receiving it
- Use the service for commercial advertising or solicitation
We reserve the right to suspend or terminate accounts that violate these rules. Because your content is encrypted, we rely on reports from recipients and automated systems to detect abuse.
4.3 Content Responsibility
You are solely responsible for the content you create and the recipients you designate. We are not responsible for the emotional impact of messages delivered through Lastlya. We encourage you to use the service with care and consideration for your recipients.
5. Subscriptions and Payments
5.1 Free Plan
The Free plan provides limited access to Lastlya features as described on our pricing page. Free accounts may display non-personalized advertisements.
5.2 Pro Subscription
The Pro subscription provides full access to all features. Subscription pricing is displayed in the App and on our website. Prices may vary by region and are set in local currency through Google Play.
5.3 Billing
Subscriptions are billed through Google Play Billing. By subscribing, you agree to Google Play's terms of service. Subscriptions auto-renew unless cancelled at least 24 hours before the current period ends.
5.4 Refunds
Refund requests are handled by Google Play in accordance with their refund policy. We do not process refunds directly. If you believe you are entitled to a refund, please contact Google Play support or email us at support@lastlya.com for assistance.
5.5 Price Changes
We may change subscription prices with 30 days' notice. Price changes will not affect active billing periods. You may cancel your subscription if you do not agree with the new pricing.
6. Message Delivery
6.1 Delivery Guarantee
We make commercially reasonable efforts to deliver your messages according to your configured schedule. However, we cannot guarantee delivery in all circumstances. Technical failures, recipient email issues, or service disruptions may affect delivery.
6.2 Inactivity Trigger
If you configure an inactivity trigger, messages will be delivered after the specified period of inactivity. Before delivery, we will attempt to notify you via email and push notification. The inactivity period is configurable in your account settings (default: 90 days).
6.3 Irrevocability
Once a message has been delivered to a recipient, it cannot be recalled or deleted by you. Before delivery, you may edit or delete any message at any time.
7. Vault Trustees
You may designate trustees who will receive access to your vault content under conditions you specify. By designating a trustee, you authorize us to share your encrypted vault contents with that person upon triggering. You are responsible for choosing trustees wisely and informing them of their role.
8. Gift of Words Program
The "Gift of Words" program provides free Pro accounts to terminally ill minors. Eligibility is determined on a case-by-case basis and may require documentation from a healthcare provider. Accounts under this program are subject to the same Terms with additional protections for minors. Parental or guardian consent is required.
9. Intellectual Property
The Lastlya name, logo, design, and code are the intellectual property of Samael Sp. z o.o. You may not copy, modify, distribute, or reverse-engineer any part of the App or Site without written permission.
10. Limitation of Liability
To the maximum extent permitted by law:
- Lastlya is provided "as is" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim
- We are not liable for the content of messages created by users
- We are not liable for emotional distress caused by delivered messages
These limitations do not affect your statutory rights under EU consumer protection law.
11. Indemnification
You agree to indemnify and hold harmless Samael Sp. z o.o. from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these Terms.
12. Service Availability
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. In the event of permanent service discontinuation, we will provide at least 90 days' notice and enable data export for all users.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of Poland and the European Union. Any disputes shall be resolved by the competent courts in Poland, without prejudice to your rights under EU consumer protection law to bring proceedings in your country of residence.

15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
